On June 5, 2022, at approximately 12:19 a.m., a New Mexico State Police officer patrolling Interstate 25 northbound observed a 1997 Buick passenger vehicle driving erratic traveling at a high rate of speed near the Paseo Del Norte exit, in Albuquerque, NM. The vehicle was traveling 100 miles per hour in a posted 65-mile-per-hour zone. The Buick exited Interstate 25 and proceeded west on Paseo Del Norte. As the State Police officer attempted to initiate a traffic stop, the driver of the Buick fled and a pursuit was initiated.
During the pursuit, the Buick continued to travel west on Paseo Del Norte at a high rate of speed. The Buick exited off at Coors Boulevard and merged back onto Paseo Del Norte eastbound. The Buick then exited off Paseo Del Norte at 2nd Street traveling north. The vehicle turned onto a dirt road that runs adjacent to 2nd Street before making a U-turn and driving directly towards the pursuing officers. As the Buick attempted to merge back onto 2nd Street from the dirt road, the suspect drove at a state police unit striking the unit head-on. After the collision, the driver of the Buick pushed the state police unit out the way and continued to travel south on 2nd Street before crashing into a ditch. The suspect and a female passenger both exited the vehicle and fled on foot.
After a short foot pursuit, the suspect, David F. Marquez (41) of Clovis, NM, and the female passenger, Gabriella Y. Ramos (18) of Clovis, NM, were both taken into custody and arrested without further incident. During the investigation, Marquez displayed signs of impairment and a subsequent DWI investigation was conducted.
Upon Marquez’s arrest, officers observed him wearing a shoulder holster magazine containing a loaded magazine with seventeen 9mm rounds. During a subsequent search of the vehicle, officers also located a loaded 9mm handgun inside the vehicle.
Marquez and Ramos were both transported to an area hospital in Albuquerque, NM where they were treated and released.
No officers were injured during the incident.
Upon Marquez’s release from the hospital, he was booked into the Albuquerque Metro Detention Center and charged with the following:
- Aggravated Fleeing from a Law Enforcement Officer
- Aggravated Assault Upon a Peace Officer (Deadly Weapon)
- Driving While Under the Influence of Intoxicating Liquor or Drugs
- Criminal Solicitation to Commit Receipt, Transportation or Possession of a Firearm or Destructive Device by a Felon
- Resisting, Evading, or Obstructing an Officer
- Speeding
- No Driver’s License
- Use of Plate/Registration Number on Another Vehicle
Gabriella Ramos was charged with Resisting, Evading, and Obstructing an Officer. She was also booked into the Albuquerque Metropolitan Detention Center.
